Our Contract

1. These Terms and Conditions govern the supply of goods sold by In The Toolbox Ltd.(No. 4043700) of Unit 2c, York Road Industrial Estate, Malton, North Yorkshire, YO17 6YA.

 

2. "We" and "Us" means In The Toolbox Ltd. "You" meaning the customer.

 

3. "Goods" means items that by this contract we will supply to you.

 

4. "Business Customer" means any person, persons or body corporate whom when making this contact with Us, does not intend to use the goods for personal and family use only, irrespective of their intended use of the goods.

 

5. "Consumer Customer" means any person with whom under this contract does not fall into the category of Business Customer as defined herein.

 

6. "Cooling off period" means a period of seven working days, as defined by Distance Selling Regulations starting the day after the goods are received by you.
 
7. "Distance Selling Regulations" means the Consumer Protection (Distance Selling) Regulations Act 2000 (SI 2000/2334) as per the date of this contract.

 

8. All orders placed by you are on the basis of these Terms and Conditions and are subject to acceptance by us by delivery of the goods to you at which point a legally binding contract is constituted between us. The processing of your payment and acknowledgment of your order does not constitute legal acceptance of your order.

 

Pricing & Payment

9. Occasionally an error may occur resulting in goods on the website may be incorrectly priced. In such circumstances we will not be obliged to supply the goods at the incorrect price.

 

10. We reserve the right to change the price of commodity goods, due to market conditions but we will confirm the prevailing price with you before accepting your order. We are not obliged to accept your order for such goods and may decline it or limit the order quantity.

 

11. We must receive payment for the whole of the price of the goods you order, and any applicable charges for delivery, before your order can be processed.

 

12. All credit/debit card payments are subject to automated validation checks by Sagepay payment services and authorisation by the card issuer with information collected via the secure online payment system. If the issuer of your credit/debit card does not authorise payment to us, we will not be liable for any delay or non-delivery.

 

Delivery

13. We will deliver the goods in accordance with your order usually within the aimed delivery time of 3 working days, but within 30 days. However, this is not a guarantee that the goods will be delivered within this specific time or at all.

 

14. In the unlikely event that we do not make the goods available to you within 30 days of accepting your order you will have the option of cancelling your order by notifying us accordingly prior to delivery.

 

15. In the unlikely event that you have not received all the goods within the stated delivery time, you must notify us within 3 working days of the date delivery was expected.

 

16. Upon the delivery of goods to you, the goods shall be at your own risk. In spite of delivery having been made, title in the goods shall not pass to you until you have paid for the goods in full at which point no other sums whatsoever shall be due to us from you.

17. If we notify you that we will not deliver any goods under this contract, we will also re-imburse you any and all monies paid pursuant to this contract in respect of the goods that we will not deliver.

 

Cancellation

18. If you are a Consumer Customer, you have the right to cancel this order within the 21 day "cooling off" period inline with the Distance Selling Regulations. On cancellation, all goods must be returned to us in the condition in which they were sent as soon as reasonably possible but in any event within 30 days, with all costs of return met by you.  You are advised to insure yourself against the risks of the goods being damaged in transit.

 

19. We reserve the right the charge at 5% fee on all cancelled orders.

 

20. If you are a Business Customer, you have no right to cancel this contract.

 

21. If this contract, or part of this contract concerns goods consisting of a) goods that have been personalised for you and/or b) Equipment that we have put together to your specification, then you have no right to cancel this contract in as much as it applies to those goods.

 

22. If you wish to exercise any right to cancel this contract, you must notify us of the same within the cooling off period, either by writing to us at our address, or by emailing us to our main email address. Upon receipt of a valid notice cancelling this contract, we will send to you within 21 days a notice confirming cancellation of the contract.

 

23. If you are not totally satisfied with your purchase or you have simply changed your mind about your purchase then in line with the Distance Selling Regulations, you can return your item provided you inform us of this decision via letter or e-mail to us within 7 working days of receipt. Once you have informed us of your decision to return goods under the Distance Selling Regulations, you have 7 working days to return the item(s) at your own expense. you will be responsible for the safe return of the goods. The goods must not be opened nor used and must be 'as new' when returned to us. All items must be complete with original packaging, manuals, peripherals etc as originally supplied. Manufacturer packaging must not be defaced in any manner. Once goods are received at In The Toolbox Ltd., we will issue a full refund for the cost of the goods to your original payment method. Please note Business Customers are exempt from returning items within 7 working days under the distance selling regulations.

 

Liability

24. If you have notified us of a problem with the goods within 30 days of delivery, we will either make good any shortage or non-delivery; replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid by you for the goods in question.

 

25. We shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions. Our liability to you shall not in any event include losses related to any business of yours, such as loss of profits or business interruption, neither will we be responsible to you for any other loss which is not a foreseeable consequence of us being in breach of these Terms and Conditions or our legal duties.

 

26. This does not affect your statutory rights if you are a consumer.

 

27. Goods are intended for use in the UK only and we cannot confirm that the goods comply with any laws, regulations or other standards applicable outside the UK. All goods are sold in accordance with the manufacturer's specifications and are subject to any qualifications, representations or instructions contained in the documentation associated with the goods.

 

Age Restriction

28. Where you place an order for age-restricted goods such as solvents and knives, you confirm that you are over the age of 18 and that delivery will be accepted by a person over the age of 18. We reserve the right to cancel your order if we reasonably believe you are not legally entitled to order certain goods.

 

Force Majeure

29. We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes).

 

General

30. All images used on this website are for illustration purposes only.

 

31. By using this website you do so at your own risk and neither In The Toolbox Ltd. or any associated companies; parent or subsidiary, any of its associates, employees or partners are responsible for any error, accident, hurt feelings or misfortune that should result or be incurred by such usage and or purchase or receipt or care of products, nor is the reliability, functionality or software guaranteed.

 

32. In The Toolbox Ltd nor any of its associated companies; parent or subsidiary, associates, employees or partners will not be liable for any amount exceeding that of the monetary value spent by any customer.
